The key question is whether California should execute a man who at the
time of his crime had severely impaired mental capacity and judgment.
Although justice and public safety require that David Raley be punished
and prevented from participating in society, executing this man, who was
afflicted with mental deficits aggravated by a dysfunctional home environment,
would not be justice. In prison, David has been a model prisoner. He continues
to function well when the rules are clearly spelled out for him. |
